When the Anderson family fell in love with a charming 1930s bungalow, everything seemed perfect until the title search revealed an unresolved lien from a contractor dispute a decade prior. As their realtor, I had seen this scenario before. Without clearing this issue, the Andersons could have inherited a legal nightmare along with their new home. This experience reinforced why a realtor’s expertise in the title search process is invaluable for buyers and sellers alike. 

While title companies and attorneys handle the technical aspects of title searches, realtors play a crucial role in ensuring a smooth transaction by identifying potential red flags early, explaining complex issues in plain terms, and coordinating between all parties to resolve problems before closing. 

What a Title Search Reveals And Why It Matters

A title search examines public records to verify the seller’s legal right to transfer ownership and uncover any claims or restrictions on the property. Common issues include outstanding liens, unpaid property taxes, easements that affect land use, or even inheritance disputes from previous owners. 

Realtors help clients understand these findings by translating legal jargon into actionable insights. For example, an easement allowing utility access might not derail a sale, but an undisclosed second mortgage could. Experienced realtors know which issues are dealbreakers versus manageable concerns, preventing unnecessary panic or overlooked risks. 

How Realtors Facilitate the Title Process

Long before closing, proactive realtors order preliminary title reports to identify potential obstacles. They review documents for discrepancies between the legal description and the actual property boundaries. If a survey shows the neighbor’s fence encroaches two feet into the yard, the realtor negotiates solutions perhaps having the seller obtain a boundary line agreement. 

When title problems arise, realtors coordinate with title officers, lenders, and attorneys to resolve them. For the Andersons, this meant working with the title company to verify the contractor lien had actually been paid but never properly released, a process that took three weeks to document properly. Without an engaged realtor pushing for answers, the deal might have collapsed. 

Preventative Guidance for Sellers

 

Smart realtors advise sellers to conduct a title search before listing their home. Discovering a forgotten home equity loan or an ex-spouse still on the deed allows time to address these issues before they scare off buyers. One seller avoided a delayed closing because their realtor spotted an old child support lien during pre-listing due diligence, giving them 60 days to resolve it rather than scrambling at closing. 

Realtors also ensure sellers understand how different deed types (warranty, quitclaim, etc.) affect buyer confidence and legal protections. This knowledge helps sellers make informed decisions when transferring property. 

While the technical work of title searches falls to professionals like attorneys and title examiners, realtors serve as essential guides through this complex process. They act as interpreters, negotiators, and problem-solvers, turning what could be a stressful ordeal into a managed transaction. For buyers and sellers alike, having a realtor who truly understands title issues means protecting what’s likely your largest financial asset. After all, you’re not just buying a house, you’re buying clear ownership of it.
