Posted by When I sold my first home, I thought my real estate agent handled everything. I was wrong. My agent handled marketing and negotiations, but when legal questions came up, she referred me to my attorney. I learned that the agent sells the home, but the attorney protects you legally. They are not the same role, and understanding the distinction is essential.
A real estate attorney specializes in legal matters related to property transactions and works to ensure the process runs smoothly and that your interests are protected. The attorney works for you and is legally and ethically obligated to prioritize your interests above all else. The sale of a home involves a legally binding contract, and the attorney’s role is to ensure that contract is fair and that all legal requirements are met. A real estate attorney is often required by law, depending on the state. In some states, an attorney must be involved at closing, while in others, they are required during the transaction itself.
The first major task my attorney handled was drafting and reviewing the purchase agreement. This contract outlines the sale price, closing date, contingencies, and personal property included in the sale. She reviewed every clause and explained the implications of each. She also negotiated terms with the buyer’s attorney to ensure the contract was as favorable to me as possible.
An attorney is also essential for resolving title issues. A title search is conducted to verify that the seller has clear ownership of the property and that no liens, unpaid taxes, or legal claims exist. If an issue arises, the attorney works to resolve it. My attorney discovered an old lien from a contractor who had worked on the house years ago. She contacted the contractor, negotiated a settlement, and ensured the lien was cleared before closing. Without her involvement, that lien could have delayed the sale and cost me money.
Real estate attorneys also handle the closing process. They prepare or review the deed, manage financial documents, and ensure the transfer of funds is handled correctly. They ensure all legal requirements are met, including tax prorations, transfer taxes, and disclosures. Having an attorney at closing gives you someone to explain the documents you are signing and to address any last-minute issues that arise.
Attorneys are especially important in complex situations like short sales, estate sales, or if there are disputes between co-owners. They also handle cases where creative financing or tenant eviction is involved, helping you avoid lawsuits down the road.
The cost of a real estate attorney varies but is generally a small price to pay for peace of mind. Legal fees typically range from $1,000 to $2,000, depending on location and transaction complexity. Many attorneys offer competitive fees and can save you from costly legal mistakes. As one lawyer put it, “I tell clients it’s a lot easier for me to look at the contract and make sure it protects you before you sign it than try to get you out of it after the fact”.
A real estate attorney is not just a luxury; in many situations, they are a necessity. They do not just file paperwork. They provide legal protection, expert advice, and peace of mind, ensuring that the most significant transaction of your life is handled correctly. I learned to never sign a contract without one.
